Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Fransisco Wiles Marketing LLC d/b/a TurfWarden ("TurfWarden", "we", "us"). By using turfwarden.com, submitting a request, or receiving calls, texts, or emails from us, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

The service

TurfWarden connects homeowners in the Greater Tampa Bay area with an independent, third-party artificial turf installer. We are not an installer and we do not perform, supervise, or warrant installations. All quotes, contracts, warranties, licensing, insurance, and work are provided by and are the sole responsibility of the matched installer. Any agreement for work is directly between you and that installer.

These Terms cover two kinds of users. Homeowners submit a request for a free estimate. Installers — independent artificial turf contractors — create a TurfWarden account at /contractor-signup to receive customer leads in their service area. Sections below marked as applying to one group apply only to that group; everything else applies to both.

Eligibility

You must be at least 18 years old and a resident of the United States.
If you create an installer account, you must be an owner or an authorized representative of the contracting business you register, and you must hold the licensing and insurance required for artificial turf work in the jurisdictions you serve.
You must be the owner, subscriber, or customary user of the phone number and email address you submit, and authorized to receive calls and texts at that number.
You must submit accurate information, and only your own contact details — never someone else's.
You must use the site for lawful purposes only.

By checking the consent box and submitting your information, you give your prior express written consent for TurfWarden and the single artificial turf installer we match you with to contact you at the phone number and email address you provided, including by:

live and prerecorded or artificial-voice phone calls;
text messages (SMS and MMS); and
email,

including through the use of an automatic telephone dialing system or other automated technology, about your artificial turf project and the estimate you requested.

Consent is not a condition of purchase. You do not have to agree to receive automated calls or texts in order to buy any goods or services. You may instead email hello@turfwarden.com to request an estimate without giving this consent.
Message and data rates may apply. Message frequency varies.
Your consent applies to TurfWarden and to the one installer you are matched with. It is not shared with, sold to, or transferred to anyone else. See our Privacy Policy.
You can revoke consent at any time, by any reasonable method — replying STOP to a text, telling us on a call, or emailing hello@turfwarden.com. We will honor your request promptly, and in all cases within 10 business days, and add you to our internal do-not-contact list.
We place calls and send texts only between 8:00 a.m. and 8:00 p.m. in your local time zone, and no more than three sales calls in any 24-hour period, consistent with the Florida Telephone Solicitation Act and applicable federal rules.
Calls may be recorded or monitored for quality and training where permitted by law. You will be notified at the start of any recorded call.

SMS text messaging terms — homeowners

Program name: TurfWarden Estimate Alerts
Program description: A conversational messaging program for homeowners who have requested a free artificial turf estimate. Messages relate to your request: confirming we received it, introducing your matched installer, scheduling and reminding you about your in-person estimate, and answering your questions. This is not a promotional or recurring marketing program.

How to opt in: Check the consent box on a TurfWarden request form and submit your mobile number. The box is not pre-checked and submitting is your affirmative opt-in.
Who sends messages: TurfWarden and the single installer we match you with.
Message frequency: Message frequency varies. Messages are conversational and sent in response to your request.
Cost: Message and data rates may apply. TurfWarden does not charge for the messages, but your mobile carrier may.
To opt out: Reply STOP to any message at any time. You will receive a single confirmation that you have been unsubscribed, and no further messages will be sent unless you opt in again. You may also reply UNSUBSCRIBE, END, CANCEL, QUIT, or REVOKE.

Carriers: Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed.
Supported carriers: Major U.S. carriers including AT&T, Verizon Wireless, T-Mobile, and their affiliates. Carrier support may change without notice.
Changing your number: If you give up or change the mobile number you provided, you agree to notify us promptly so we do not message the next person assigned that number.
Privacy: Your mobile information and SMS consent are never shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

SMS text messaging terms — installers

Program name: TurfWarden Lead Alerts
Program description: An operational messaging program for artificial turf contractors who hold a TurfWarden account. Messages notify you that a new customer lead has been assigned to your account and include the details you need to follow up, along with related account and lead status notifications. This is not a marketing or promotional program.

How to opt in: Create an account at /contractor-signup or open your account settings, enter your business mobile phone number, and check the SMS consent box. The box is never pre-checked, and checking it is your affirmative opt-in. By submitting the form you agree to receive operational SMS notifications from TurfWarden.
Consent is not a condition of account creation or of receiving leads. You may create and keep an account, and receive leads by email instead, without agreeing to SMS.
Who sends messages: TurfWarden only. Homeowners do not message you through this program.
Message frequency: Message frequency varies based on the number of leads assigned to your account.
Cost: Message and data rates may apply. TurfWarden does not charge for the messages, but your mobile carrier may.
To opt out: Reply STOP to any message at any time. You will receive a single confirmation that you have been unsubscribed, and no further lead alerts will be sent unless you opt in again. You may also reply UNSUBSCRIBE, END, CANCEL, QUIT, or REVOKE, or turn SMS off in your account settings. Opting out of SMS does not close your account or stop lead delivery by email.

Number you provide: You must be the owner, subscriber, or customary user of the business mobile number you enter, and authorized to receive texts at it. If the number changes or the person who carries it leaves your business, update your account settings promptly.
Carriers: Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed. Do not rely on SMS alone as your record of assigned leads — your account is the system of record.

Installer account obligations

Lead information is provided so you can contact that homeowner about the estimate they requested. You may not use it for any other marketing, sell or transfer it, or share it onward.
When you contact a homeowner assigned to you, you are responsible for your own compliance with the TCPA, the Florida Telephone Solicitation Act, and any other applicable calling and texting law, including honoring opt-out requests made directly to you.
A homeowner's consent to be contacted covers you as the matched installer only. It does not transfer to other numbers, brands, or businesses you operate.
You must keep your account details, service area, and licensing information accurate. We may suspend or close an account that is inaccurate, unresponsive to assigned leads, or in breach of these Terms.

No guarantees

We aim to match you with a qualified, verified installer, but we do not guarantee availability, response times, pricing, workmanship, or any outcome. The site and service are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose.

For installers: we do not guarantee any number of leads, any lead quality, any conversion rate, or exclusivity in a service area.

Limitation of liability

To the fullest extent permitted by law, TurfWarden is not liable for the acts, omissions, workmanship, representations, or agreements of any installer, or for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim relating to the service will not exceed one hundred dollars ($100).

Indemnification

You agree to indemnify and hold harmless TurfWarden from any claim arising out of your submission of a phone number you are not authorized to provide, your breach of these Terms, or your violation of any law.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Hillsborough County, Florida.

Changes to these Terms

We may update these Terms. Changes take effect when posted, and the "Last updated" date above will change. Your continued use of the service after a change means you accept the updated Terms.
